Please read these terms of use carefully before you start to use the site. By using our site, you indicate that you accept these terms of use and that you agree to abide by them. Information about us

www.mykidstime.ie is a site operated by Mykidstime Limited (we, us or our). We are registered in Ireland under company number 433713 and have our registered office at 24 Oran Glen, Oranmore, County Galway.

Accessing our site

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.

From time to time, we may restrict access to some parts of our site, or our entire site, to users who have registered with us.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.

You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms, and that they comply with them.

Cookies are digital files that websites (including mykidstime.ie) use to save snippets of information on your computer or phone about your browsing experience. This information is given back to us each time you open a new page on our site and helps us to give you a more personalised experience, make it easier to find what you’re looking for and allow you to perform online bookings.

Cookies have been used by websites for many years, but EU law now asks us to inform you and confirm you are OK with this.

MyKidsTime.ie uses cookies for the following primary purposes:

  • To remember your location when you have chosen on Near Me
  • To manage your user login status during browsing sessions
  • To remember your most recent search criteria when searching our site (so we can redo the search for you when you return to the search page)
  • We also have a range of affiliated websites who use ‘third party’ cookies on our site to help us with maintaining site usage statistics and presentation of advertisements.

Acceptable use

You may use our site only for lawful purposes. You may not use our site:

  • in any way that breaches any applicable local, national or international law or regulation;
  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  • for the purpose of harming or attempting to harm minors in any way;
  • to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards set out in these terms of use;
  • to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); or
  • to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

You also agree:

  • not to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of these terms of use;
  • not to access without authority, interfere with, damage or disrupt: any part of our site; any equipment or network on which our site is stored; any software used in the provision of our site; or any equipment or network or software owned or used by any third party.

Interactive services

We may from time to time provide interactive services on our site, including, without limitation, through forums, chat rooms or bulletin boards.

Where we do provide any interactive service, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used.

We will do our best to assess any possible risks for users (and in particular, for children) from third parties when they use any interactive service provided on our site, and we will decide in each case whether it is appropriate to use moderation of the relevant service in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

The use of any of our interactive services by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use an interactive service that it is important that they communicate with their children about their safety online, as moderation is not foolproof. Minors who are using any interactive service should be made aware of the potential risks to them.

Where we do moderate an interactive service, we will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.

Content standards

These content standards apply to any and all material which you contribute to our site (contributions), and to any interactive services associated with it.

You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any contribution as well as to its whole.

You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Reliance on information posted

Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. All visitors and Buyers (as defined below) should undertake their own assessments and enquiries in relation to any services or offers mentioned on the site and any Listings (in particular before making any Offer (as defined below)). We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.

Our site changes regularly

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

Our liability

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:

all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity;
any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for: loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

Information about you and your visits to our site

We process information about you in accordance with our privacy policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate.

Transactions concluded through our site

“Buyer” means any person who has completed the registration process and placed an Offer;

“Listing” means a listing provided by us on the site on behalf of a Seller, which provides information as to the goods and/or services available for purchase from the Seller;

“Offer” means an offer made by a Buyer to purchase goods and/or services from a Seller on the basis of information provided in a Listing. An Offer is made by the Buyer: (a) completing all the details specified on our site and required by the Seller to make the Offer; and (b) making payment of the non-refundable booking fee in the amount and currency specified for that Order on the site (“Booking Fee”);

“Seller” means a third party which makes goods and/or services available for purchase via the site in accordance with its terms and conditions of supply and the terms set out on our site (including any terms provided in the Listing).

An Offer, once made by a Buyer, is irrevocable. Once the Offer is accepted by the Seller, a binding contract is established between the Buyer and the Seller.

We act solely as an agent or intermediary for Buyers and Sellers wishing to buy or sell goods and/or services via our site. We are not part to any contract formed between a Buyer and/or Seller and accept no liability for that contract.

These terms of use set out the sole basis upon which Buyers may access and use the site to make Offers and purchase Goods and/or Services from the Seller via the site. If you do not agree to accept or abide by these terms of use, you must immediately cease to use the site and not make any Offers.

Please note that, for the convenience of Buyers, we have also provided guidelines in response to frequently asked questions under the “Your Questions and Our Answers” section of the site. Information provided under those guidelines forms an integral part of these terms of use. Where conflicting information is set out in those guidelines, these terms of use shall take precedence.

Our liability for contracts formed via the site

We provide an agency service whereby Buyers and Sellers with specific needs are introduced to each other and agree to contract for goods and/or services. At no time do we warrant or guarantee the condition, quality and/or suitability of any goods and/or services offered by a Seller via the site. Any comments provided by us on the site are given as our good faith opinions only, and the Buyer should undertake its own assessment as to the goods or services offered by the Seller before making an Offer. We do not accept, and hereby expressly exclude, all liability, whether direct, indirect or consequential, for any issues arising out of purchase of goods and/or services by a Buyer from a Seller, including, without limitation, late or non-delivery. We do not accept liability for, or check the accuracy or completeness of, any information provided by a Seller, whether in a Listing or otherwise.

Please note that (unless otherwise specified expressly in a Listing) Sellers are not deemed to provide, and rather exclude (to the fullest extent permitted by applicable law, and subject to any rights and remedies you may have as a consumer under statute) all warranties (express or implied) in relation to the condition, quality and/or suitability of any goods and/or services described in a Listing.

By making an Offer, the Buyer warrants that it has assessed for itself the suitability, quality and condition of the goods and/or services it is purchasing from the Seller. In the event that any issue arises in relation to goods and/or services purchased by a Buyer from a Seller via the site (including, without limitation, as to their quality), the Buyer should approach the Seller directly to resolve such issue.

Unless otherwise agreed by us, the Booking Fee, once paid by the Buyer, is non-refundable and shall not be repaid to the Buyer in any circumstances.

To the extent not otherwise excluded by the provisions of these terms of use, and to the fullest extent permitted by applicable law, our entire liability to a Buyer arising out of or in connection with these terms of use and any Offer made shall be limited to the Booking Fee paid by the Buyer for the Offer in respect of which the liability arose.

Buyer’s obligations

The Buyer shall pay the Booking Fee in accordance with the terms specified on our site.

The Buyer shall be liable for any loss suffered by us as a result of the Buyer’s negligent transmission of defective and/or viral data.

Please note that we reserve the right, acting at our discretion, to decide whether or not to process Orders, for any reason and at any time.

If at any time any provision of these terms of use is or becomes invalid, illegal or unenforceable in any respect under the law of any applicable jurisdiction, neither the validity, legality and enforceability of the remaining provisions nor the validity, legality or enforceability of such provision under the law of any other jurisdiction shall in any way be affected or impaired.

Except where the context otherwise requires, each of the restrictions contained in these terms of use and in each clause, sub-clause and paragraph of them shall be construed as independent of every other restriction and of every other provision of these terms of use to the intent that if any provision of these terms of use or the application of any provision to any person, firm or company or to any circumstance shall be determined to be invalid and unenforceable then such determination shall not affect any other provision of these terms of use or the application of such provision to any other person, firm, company or circumstance.

The Buyer hereby requests that we communicate with it and any correspondents connected with the matter by email provided.

The Buyer acknowledges, accepts and agrees that email messages may be intercepted and read by anyone other than the Buyer and specifically confirms that we will not be responsible in any way should this occur.

We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our site.

We have the right to remove any material or posting you make on our site if, in our opinion, such material does not comply with these terms of use.

If you make a posting to our site that relates to a Seller, or any goods and/or services offered or provided by the Seller, please be aware that (regardless of whether the posting is negative or positive) we will permit the Seller to publicly respond to your comments on our site.

We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.
